Catalot Seller Agreement
Version 2026-10-22. Effective October 22, 2026.
The short version
- What you pay: a monthly plan plus a share of what sells. Starter is $79 a month and 3.5% of hammer, Pro is $199 and 3%, Volume is $499 and 2.75%. Above $15,000 of hammer in one sale, the share is half that rate. No setup fees and no per-bid fees.
- How buyers pay you: card payments go straight into your own Stripe account. You are the seller of record. Catalot takes its share when the card is charged.
- Cash or check at pickup: we bill our share monthly, only on lots that were picked up.
- What you handle: your items, your descriptions, pickup, shipping, refunds and buyer questions.
- What we handle: the software, the marketplace, charging cards, and keeping the platform running.
- Cancel anytime on a monthly plan. We give you 30 days' notice before any price change.
The rest of this agreement says the same things in more detail. If anything in the short version and the details disagree, the details win.
1. Who this agreement is between
This agreement is between CATALOT LLC, a Missouri limited liability company ("Catalot", "we"), and the auction or estate sale company that signs up to sell on Catalot ("you"). The person who accepts it confirms they can sign for the company. It sits alongside Catalot's Terms of Use and Privacy Policy. Where this agreement and the Terms of Use disagree about selling, this agreement wins.
2. Plans and fees
2.1 Subscription. You choose a plan: Starter ($79 a month), Pro ($199 a month) or Volume ($499 a month). Each plan includes the features listed on the Pricing page, including a monthly allowance of AI listing drafts. Drafts beyond the allowance are billed at the price shown on the Pricing page.
2.2 Share of what sells. For each sale, we charge a share of the hammer price of lots sold: 3.5% on Starter, 3% on Pro and 2.75% on Volume. In any one sale, the share is half that rate on hammer above $15,000. Hammer means the winning bid, not including buyer's premium, tax or shipping.
2.3 No other platform fees. We don't charge setup, activation, per-bid or card-authorization fees.
2.4 Free months. New sellers get the first 2 months of their subscription free, counted from when their first sale closes, as long as they close at least 2 sales in each of those months. The share of what sells applies from the first sale. A card is required at signup.
2.5 Yearly plans. If you prepay a year, you pay for 10 months and get 12.
2.6 Launch partners and custom rates. Any special offer, such as launch-partner free months or a capped rate, must be confirmed by Catalot in writing (including in your account settings). It applies for the period stated, then the standard rates apply.
2.7 Shipping labels. If you buy shipping labels through Catalot, the shipping charge collected from the buyer covers the postage, the label fee shown when you buy the label, and a 0.5% share of the shipping charge. These are taken from the shipping charge when it's paid. There is no share on buyer's premium or sales tax.
2.8 Taxes on our fees. Our fees don't include any tax that applies to them. You pay those.
3. How buyers pay, and how we collect our share
3.1 Card payments. Buyers' cards are charged into your own Stripe account. You are the merchant of record for your sales: the sale is between you and the buyer. Stripe's own processing fees are charged to your Stripe account under your agreement with Stripe.
3.2 Our share on card sales. Our share is taken automatically as part of each card charge. It is due whether or not the buyer picks up the item, unless you refund the buyer.
3.3 Refunds. You decide and issue refunds from your Stripe account. When you refund a buyer, our share on that amount is reduced in the same proportion. We don't issue refunds on your behalf.
3.4 Chargebacks. Chargebacks and disputes are handled on your Stripe account and are your responsibility, including any dispute fees. Catalot provides the records it has (bids, invoices and pickup check-in records) to help you respond.
3.5 Cash, check and other in-person payments. When a buyer pays you in person instead of by card, we charge our share only on lots the buyer actually picked up, as recorded at pickup in Catalot. We add it to your monthly Catalot invoice. Lots that are never picked up or are forfeited carry no share. Each lot is billed once.
3.6 Paying your Catalot invoice. Your subscription and any amounts under 3.5 are charged to the card on file for your account each month. If a charge fails, we'll retry and tell you. Amounts unpaid after 15 days may lead to suspension under section 8.
4. Your responsibilities as a seller
4.1 Your items and listings. You are responsible for the items you sell and how you describe them: accurate titles, descriptions, condition and photos of the actual item. AI drafts are suggestions until you approve them; once you publish, the listing is yours.
4.2 Your terms of sale. You set your terms: buyer's premium, pickup times, shipping, returns and any other conditions. They must be shown to buyers before they bid, and they must not conflict with this agreement or the law.
4.3 The law. You are responsible for following the laws that apply to your sales, including licensing, sales tax collection and remittance, and rules for regulated items such as firearms, alcohol, ivory and similar goods.
4.4 Fair bidding. You, your staff and anyone acting for you must not bid in your own sales or arrange bids to raise prices. Catalot blocks your staff from bidding in your sales and records any attempt.
4.5 Pickup, shipping and buyer service. You handle pickup, shipping and questions from your buyers, and you answer buyer messages promptly. Catalot provides the tools.
4.6 Your account. Keep your staff accounts secure, use two-step sign-in where offered, and remove staff who no longer work for you. You are responsible for what your staff do in Catalot.
5. Buyer data and privacy
5.1 What you receive. When buyers register for your sales, you receive their contact details, bids, invoices and pickup or shipping details so you can run the sale.
5.2 How you may use it. Use buyer data only to run your sales, serve your buyers, and send them your own marketing that they can unsubscribe from. Don't sell it or share it with anyone else except as needed to complete their purchase (for example, a shipper). Keep it secure.
5.3 Privacy requests. If a buyer asks you to see or delete their data, you handle it for the data you hold. Catalot handles requests about data it holds.
5.4 Consignors. You are responsible for the information you enter about your consignors and for your agreements with them.
6. Catalot's responsibilities
6.1 The platform. We provide and maintain the software, the Catalot marketplace and your storefront, and we work to keep them secure and available. We may improve or change features over time.
6.2 Support. We answer seller questions at support@catalot.com.
6.3 Card data. Card numbers are handled by Stripe. Catalot never sees or stores them.
7. Price changes and changes to this agreement
We'll tell you at least 30 days before any change to your plan price or share takes effect, by email and in your account. Changes don't apply to a sale whose first lot closes before the change takes effect. If you don't agree, you can cancel before the change takes effect. We may update other parts of this agreement, and we'll post the new version with its date and ask you to accept it before your next sale is published.
8. Suspension and closing an account
8.1 When we may suspend. We may warn, suspend or close a seller account for serious or repeated problems, including: unpaid Catalot fees after 15 days, shill bidding, misdescribing items, not delivering items buyers paid for, ignoring buyers, or breaking the law or this agreement.
8.2 What suspension means. While suspended, you can't publish new sales or add lots, and your listings are hidden from the marketplace. Sales already open keep running unless we need to stop them to protect buyers. You can still sign in to handle invoices, pickups and payouts.
8.3 We tell you why. We'll tell you the reason and how to respond, and we'll reinstate the account once the problem is resolved where that's possible.
9. Cancelling
You can cancel a monthly plan anytime in Billing settings. It ends at the end of the month you've paid for, with no cancellation fee. Yearly plans run to the end of the prepaid year and aren't refunded for unused months. You must finish sales that are already open, including pickups and refunds, and pay any amounts owed. Records we must keep for tax, invoices and the law are kept after you leave.
10. Content you upload
You keep ownership of your photos, descriptions and other content. You give Catalot permission to use them to run and show your sales, on your storefront and the Catalot marketplace, in sold-price history, and in emails and posts about your sales. You confirm you have the right to use what you upload.
11. Liability
11.1 Catalot provides the platform as it is and as available. We don't guarantee that any sale will reach a particular price or number of bidders.
11.2 To the extent the law allows, Catalot is not liable for indirect or lost-profit losses, and our total liability under this agreement is limited to the fees you paid us in the 12 months before the claim.
11.3 You agree to cover Catalot for claims that arise from your items, your listings, your terms of sale, your handling of buyer data, or your breaking this agreement or the law.
12. General
This agreement is governed by Missouri law. Any dispute will be handled in the courts of St. Charles County, Missouri. If any part of this agreement can't be enforced, the rest still applies. Neither side may transfer this agreement without the other's consent, except to a company that takes over the business. Notices to Catalot go to support@catalot.com or PO Box 13, Saint Charles, MO 63302; notices to you go to your account email.
